What is deemed suspension?
Under regulation 2.1.7(2), as substituted on 10 March 2026, a licence or registration is deemed suspended if the annual fee isn’t paid or a required return isn’t filed on time. You may not carry on the food business while it’s suspended. No notice is issued first.
When is the annual fee due?
The regulation says “as specified by the Food Authority”, and no specification has been published yet. Until it is, we count it from the anniversary of your grant date and tell you that’s what we’re doing.
Which businesses file Form D-1?
Manufacturers and importers file an annual return by 31 May for the previous financial year. For dairy, the regulation adds a half-yearly Form D-2, but FSSAI’s July 2022 FAQ says D-2 was discontinued from 2020-21 — confirm with your licensing authority.
How often will we be inspected?
Inspection frequency is now risk-based (regulation 2.1.17): the type of business, your past compliance, third-party audit results and the risk of the food you handle all count. Clean records are how you move down the list.
