A home baker needs an FSSAI Registration, at ₹100 a year, as long as annual turnover stays under ₹1.5 crore. The registration is for your kitchen; the labelling rules follow every cake, cookie or loaf you sell pre-packed.
A home baker who makes and sells bakes needs a Registration: ₹100 a year while turnover is up to ₹1.5 crore. Above ₹1.5 crore it becomes a State Licence at ₹5,000. Our reading is that a baker makes the product, so the manufacturing kind of business covering bakery wares fits better than a shop row.

Registration while turnover is under ₹1.5 crore
Since 1 April 2026 the manufacturing rows use turnover alone: Registration up to ₹1.5 crore, State Licence from ₹1.5 crore to ₹50 crore. Nothing on the certificate changes as you grow, so watch the number yourself. Crossing it puts you on the wrong tier.

A cake box or cookie jar you seal and sell is pre-packaged food. It needs the mandatory elements: name of the food, ingredients, nutrition, the veg or non-veg mark, allergens, your name and address, the FSSAI logo with your number, net quantity, batch, date marking and MRP.

The regulations define non-vegetarian food as food containing any part of an animal, eggs included, as an ingredient. A sponge made with egg carries the brown non-veg mark. "Eggless" bakes carry the green mark.

Declare the actual cereal or nut: "contains wheat, milk, almond", not "contains gluten, nuts". Bakery is the category where wheat, milk, egg and nut are almost always present.

"Natural", "fresh", "pure", "100%", "sugar-free" and health claims each carry conditions. A misleading claim or advertisement can draw a penalty of up to ₹10 lakh.

Selling pre-packed goods by weight brings in a separate law: register as a packer within 90 days of starting to pre-pack, a one-time ₹500 fee, and show net quantity and MRP correctly.

A retail row describes buying and reselling. If you bake the product, the manufacturing row describes what you actually do. A licence covers only the kinds of business written on it.
A home-printed sticker with the brand name and phone number is not a label. Missing a mandatory element counts as misbranding, which can draw a penalty of up to ₹3 lakh (FSS Act s.52).
Claims in posts and listings are advertising. Each claim has conditions, and a misleading one carries up to ₹10 lakh under s.53.
Nothing on the certificate tells you when you have outgrown it. Past ₹1.5 crore you need a State Licence, and trading on the wrong tier counts as trading without the right licence.

FSSAI licence for home bakery: questions
Do home bakers need an FSSAI license?
Yes. Baking at home to sell is a food business and needs an FSSAI Registration, at ₹100 a year while turnover stays under ₹1.5 crore. The one exception FSSAI's FAQ describes is a registered member of a cooperative, Mahila Udyog, self-help group or similar society that itself holds an FSSAI licence or registration. That member does not need a separate one.
What are the FSSAI registration fees for home bakers?
The government fee is ₹100 a year, paid by you directly to FSSAI on the portal. If your turnover goes past ₹1.5 crore, you move to a State Licence at ₹5,000 a year. Our fee for filing a Registration is ₹4,500, one-time plus GST. There is no renewal any more, but the annual fee must be paid to keep the registration valid.
Which FSSAI category is right for home bakers?
Our reading is the manufacturing kind of business that covers bakery wares, because you make the product. Choose the food categories for what you bake, such as cakes, biscuits and breads. If you also resell bakes made by someone else, add the retail row. If you serve customers on site, add Restaurants. FSSAI's table doesn't name home bakers, so this is our reading.
How do I get an FSSAI license for my home bakery?
Apply online at foscos.fssai.gov.in, FSSAI's official portal. Pick the kind of business and food categories, upload your photo, ID, proof of premises and product list, and pay ₹100. The 2026 amendment provides for instant registration when the application is complete. Put the registration number on your labels and display board, and pay the fee every year.
Does a home bakery registration ever expire?
No. Since the amendment of 10 March 2026, licences and registrations are perpetual and FSSAI says businesses are not required to renew. Two things can still stop you trading: an unpaid annual fee, which deems the registration suspended without notice, and a change in what you do that the certificate no longer describes.
Do I need anything extra to sell cakes on delivery apps?
Your own registration number, displayed. FSSAI's advisory of 03.12.2024 tells e-commerce food businesses not to list a seller without its valid licence or registration, and to show sellers' numbers and hygiene ratings prominently. Packaged products sold that way must have at least 30% of their shelf life, or 45 days, left at delivery.
What about home bakery licences in Texas, California or Ohio?
Those searches are about US cottage food laws, which are set state by state in the United States and have nothing to do with FSSAI. This page covers India only. If you bake in India, including for export, the FSSAI rules above apply. Exporting food brings in a Central Licence at any turnover.
